LEGISLATION
Legislation overrides Deed Restrictions and Bylaws when it is more restrictive than what is in place

There are many factors that affect the way that a POA functions. First are the ByLaws,
in conjunction with the Deed Restrictions and then Legislation. The following primarily
reflect changes effective on September 1, 2021 at the 87th Texas Legislative Session.
These can be reviewed in depth on the Internet.

1. Religious Displays - POA cannot prohibit religious displays on owner's property within limits
specified in Deed Restrictions.
2. Golf Carts - Permits golf Carts (w/o plates) to operate in master planned communities & single-family subdivisions
3. Board Member (or family member in household) may not serve on the Architectural Committee
4. POA's must provide a website to provide the current versions of dedicatory instruments (such as
Deed Restrictions),
5. Members of the same household cannot hold positions on the Board concurrently.
6, The POA cannot prohibit a Property Owner from building or installing a Security Measure.
7. HB1927 allows anyone over the age of 21 to legally carry a firearm without a license
8. SB6 allows the POA to inform Property Owners of liability issues related to Pandemics.
